Your Rights as a Parent
When a married woman has a child, there is a legal presumption that the husband is the biological father of the child. In a situation where a woman has a child and is not married, she must bring a paternity action to establish the father of the child if she wishes to get an order for child support.
Likewise, a father that was not married to the biological mother must make a motion to a court of law to establish paternity if he wishes to obtain an award of custody or visitation.
